ATG Terms and Conditions of Sale for ESA Physical Shops

These Terms and Conditions of Sale apply to all purchases of merchandise made by consumers (“you”) from ATG Europe B.V. or one of our subsidiaries (“we”) through the European Space Agency (ESA) physical shops we are operating within the European Union. 

1. ESA Name and Logo – No ESA Liability

THE ESA ACRONYM AND LOGO ARE REGISTERED TRADEMARKS OF THE EUROPEAN SPACE AGENCY. ESA IS NOT RESPONSIBLE FOR THE OPERATIONS, INCLUDING THE PRODUCTION AND DISTRIBUTION OF ANY PRODUCTS AND DISCLAIMS ANY AND ALL LIABILITY. 

2. Payment

All prices are inclusive of applicable VAT and displayed in the local currency of the shop. We accept contactless card payments. Other payment methods may be available – please check in store. We do not accept cash due to the difficulty of maintaining sufficient cash reserves to provide change and to avoid any security concerns. 

3. Returns & Exchanges

If you’re not happy with your item, you can return or exchange it within 14 days of purchase. 

  • Returns are only accepted for in-store purchases. We cannot accept returns or exchanges for purchases made in the online ESA Shop because those are operated by a different company. 
  • Items must be unworn, in original condition, with tags attached, and with a receipt. 
  • Exchanges are available for the same item in a different size or colour, subject to availability. 
  • You may return or exchange your item at only in stores in the same country where you bought it. 
  • Refunds are made via card used in original transaction if items were paid by card, otherwise by bank transfer. 

4. Defective or Non-Conforming Products 

If a product is defective or does not conform to the contract, you are entitled to statutory remedies under applicable EU and national consumer protection laws. Please contact us promptly through the email address found on your receipt or by visiting the store where you bought the product if you believe a product is defective or non-conforming. Due to how our shops operate, the only remedy we will provide in these cases is an exchange (replacement) of defective/non-conforming items. 

5. Liability

Our liability for any loss or damage in connection with your purchase is limited to the total amount paid by you for the relevant product(s). However, nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded by law. 

6. Protection of Personal Data

We process your personal data in accordance with applicable data protection laws and our Privacy Notice, available on our website at https://www.atg-europe.com/privacy-statement/ (see section 2 on linked site). 

7. Applicable Laws and Disputes

These terms follow the consumer protection laws of the country where the purchase was made. They do not limit your legal rights. Disputes will be handled under local law and by local courts. If you’re based in another EU country, you may also be able to use the European Small Claims Procedure to resolve disputes.
